What HOAs Say About Solar Panel Installations

Buy Solar LeadsIf you have a solar prospect who lives in a community where there is a homeowner’s association (HOA), it is important to make sure that the HOA allows solar panels to be installed in their community. An HOA can deny a solar installation for a number of reasons, but in most cases, it all comes down to the state in which it is located.

Common Reasons for Solar Installation Denials by HOAs

In most cases, an HOA will only prevent a homeowner from having solar panels if the state they are in requires approval for the installation and then rejects the proposal. But occasionally, a homeowner’s association may deny the installation if they believe it will negatively affect the community’s aesthetics.

Most states will indicate whether an HOA has the right to prevent a homeowner from having access to solar power, so the best bet is for the client to check their state’s solar access laws and solar easements.

HOAs and Solar Access Laws

If the state has solar access laws, then the HOA will not be able to prevent the client’s access to solar energy. But it can tell you where and how you can have the solar panels installed. For instance, in historic districts, preservation is a consideration, so no permanent fixtures are allowed on the buildings. In such a case, the solar panels would need to be installed in an alternative way than the usual rooftop installation.

How Your Client Can Help Their Case

If you have a client and the HOA is preventing them from going solar, then you can advise your client to try to get approval by sharing and reinforcing the positive benefits of solar homes in a neighborhood. For instance, solar can help homeowners save money, it can increase real estate values, it supports the local economy, and it decreases the neighborhood’s carbon footprint (a potential selling point!).

You can also recommend the client find other property owners in the neighborhood who are either interested in solar or at least on board with the technology. If the HOA is having a problem with the visibility of solar panels, then the client may want to see if they will approve the use of solar shingles or other less conspicuous solar technologies as they are developed.
